Privacy Policy Statement

This Privacy Policy describes how Morongo Band of Mission Indians (collectively, “Morongo”, “us”, “we”, “our”) collects, uses, and discloses personal information through websites (“Websites”) and mobile apps (“Apps”) operated by Morongo that link to this Privacy Policy (together, the “Services”). This Privacy Policy does not apply to other online services that we control and maintain, but do not link to this Privacy Policy. We may also provide additional or supplemental privacy notices to you at the time we collect your personal information.

By visiting or otherwise using the Services, you agree to our Terms of Use and consent to Morongo’s collection, use, and disclosure practices, and other activities as described in this Privacy Policy, and any additional privacy statements that may be posted on an applicable part of the Service. If you do not agree and consent, please discontinue use of the Service and uninstall the Apps downloads and applications.

COLLECTION OF INFORMATION

Information You Provide. You may choose to provide us with personal information, which is information that can be used to identify you individually, when you interact with our Services. This information may include

  • Personal Identifiers such as your name, email address, phone number, mailing address, and your Morongo Rewards number
  • Demographic Information such as your date of birth to verify your age when you participate with Morongo Casino
  • Financial and Commercial Information such as your tokenized payment card (e.g., credit card or debit card) information, purchase history, tendencies, and the products you requested when you make purchases on the Services
  • Health information such as your health conditions when you complete our spa intake form
  • Online and other technical information such as your geolocation data

We may collect the information above through various sources, including

  • Directly From You. This includes when you complete a form on our Website, sign up for email communications, create an account, enter promotions and sweepstakes, make a reservation or purchase, contact customer service, visit in-person to one of our casinos or hotels, or otherwise interact with us.
  • From Our Vendors. Vendors, including those that help operate our business on our behalf, may provide us your personal information in connection with the Services, such as payment processors, room booking and management vendors, online service hosting services, and customer support service providers.
  • Other External Sources. This includes our partners and affiliates (such as in connection with a co-marketing agreement), other individuals (such as when they refer you to sign up for our loyalty program), and social networks (such as when you interact with our official pages on a social network).

Information Collected Automatically

We, and our vendors, may use cookies, pixels, and other tracking technologies (collectively, “cookies”) that automatically or passively collect information when you interact with the App. For example, these cookies may collect your IP address and device identifiers. Cookies can allow a website to recognize a visitor’s device, record a visitor’s preferences, track pages that are popular on a website. Information Collected Through Your Device. When you download or access our Services, we may (depending on your device or permission settings) have access to certain information from your device, such as:

  • Location Information. We may use location-aware technologies to locate you (as determined by your IP address, GPS, Bluetooth, or Wi-Fi signals, including information about nearby Wi-Fi networks, location beacons, and cell towers) for purposes such as verifying your location or personalizing the Apps to provide you with more location-relevant content or services. Tracking technologies may also be used to enable security features and permit us to detect activity that might violate our terms.
  • Device Information and Device ID. We may get information about the device you use, including the model of your device and its operating system, your IP address, or device ID or other unique identifier.
  • Usage Data. When you use the Apps, we may get certain information such as the time and length of your App use and other usage data.

We may use Software Development Kits (“SDKs”) to collect information when you use the Apps. SDKs are blocks of code that may be installed in a mobile application to understand how visitors interact with the mobile application and collect certain information about the device and network used to access the mobile application, such as the advertising identifier associated with your device.

Additionally, you may be able to log into the App using your device’s login features such as using a passcode or facial recognition or unlock. These device login features are facilitated through your device, not Morongo; we do not control these features, which you can change by accessing your device settings and preferences.

Information Collected From Third Parties. Our vendors may share the Personal Information that you submit to them with us. For example, when you make a purchase on our Website, your payment may be processed by Authorized.net and information you provide to Authorized.net may be disclosed to us. We may combine information that we have about you with information we obtain from third parties.

USE OF PERSONAL INFORMATION

We may use your personal information for various purposes, including as directed by you, such as for the following purposes:

  • Provide Services. To provide, maintain, and upgrade products and services, including those that you request. For example, we may the information you provide to us to understand your preferences and whether we need to provide any accommodations.
  • Customer Service. To respond to your requests for technical support, product information, or any other communication you initiate, including requests and inquiries.
  • Research and Development. We may develop, create, or improve new products or services, including using personal information for internal purposes related to certain research, analytics, development, demonstration, innovation, testing, monitoring, and administrative purposes.

DISCLOSURE OF PERSONAL INFORMATION

Morongo may disclose personal information we have collected via the Services to affiliates, business partners, vendors, and other parties. For example, we may use vendors to help us operationally or to administer activities on our behalf, such as maintaining our reservation systems. In addition, we may disclose personal information in the event we engage in business transactions, for example, a merger, liquidation, reorganization, or any other business transaction, including negotiations of such transactions.

We may also disclose your personal information (1) to comply with legal requirements (for example, to respond to court orders, subpoenas, government or law enforcement agency requests, or other legal processes); (2) to protect or defend Morongo; (3) where we perceive a threat or risk to individuals or property as a result of activity on our Services; (4) in connection with an individual’s inappropriate use of our Services, noncompliance with our Terms of Use, or a complaint filed about your use of our Services; or (5) with your consent or at your direction. To the extent we grant third parties access to personal information collected via your mobile device, they are expected to follow privacy practices no less protective than our practices to the extent allowed by applicable law.

SWEEPSTAKES, CONTESTS, AND OTHER PROMOTIONS

You may participate in our surveys, contests, sweepstakes, and other promotions. We may request information for your participation (such as your contact information, photos, personal opinions, preferences, and interests). Participation in these promotions is completely voluntary. Contact information may be used to notify winners and award prizes. Your personal information may be disclosed to third parties or the public in connection with the administration of a promotion, including in connection with winner selection, prize fulfillment, and as required by law or permitted by the promotion’s official rules, such as on a winner’s list. From time to time, we offer coupons, specials, or other discounts to consumers who have opted-in to our Morongo Rewards program. Consumers may enroll in our Morongo Rewards program only after you provide prior opt-in consent. Participation in our rewards program gives consumers the opportunity to accrue points with qualifying purchases that can be redeemed for rewards.

YOUR CHOICES

Unsubscribing from Email Marketing. If you no longer wish to receive marketing emails from us, please click on the unsubscribe link in the relevant email. If you opt out of marketing emails, we may still send you administrative emails, such as those related to your account and your requested services.

Deleting Your Account. If you wish to delete your account and associated account data with your App account, please click “Log Out and Delete User Data” in the relevant app or email us at [email protected] and request your account deletion.

Device Settings and Permissions. You can use your mobile device settings to limit mobile tracking technologies and our collection of certain information. Please note that some App features may not function properly if certain permissions are disabled or settings are changed.

With respect to Apps, you can stop all collection of data generated by use of the App by uninstalling the App. Also, you may be able to exercise specific privacy choices, such as enabling or disabling certain features (e.g., location-based services, push notifications, accessing calendar/contacts/photos), by adjusting the permissions in your mobile device and/or the App’s settings. Beware that if GPS precise location services are disabled, other means of establishing or estimating location (e.g., connecting to or proximity to Wi-Fi) may persist.

You may be able to enable or disable location tracing on the App by adjusting the permissions in your App account settings or through your mobile device settings. Note that uninstalling the App or changing the App permissions will not delete your user account or any information we previously collected via the App.

DATA SECURITY AND RETENTION

We take reasonable measures to help protect personal information collected through the Services from loss, theft, misuse, and other unauthorized access, disclosure, alteration, or destruction. Nevertheless, transmission via the Internet is not completely secure and we cannot guarantee the security of your information collected through the Services.

We retain your personal information to achieve the purposes for which the personal information was collected, or as may otherwise be permitted or required under applicable law.

THIRD PARTY LINKS AND FEATURES

When using the Services, you may come across links related to third-party websites and services that we do not operate or control. This includes any online services operated by our vendors that provide us your personal information at your direction (such as through certain portals, webforms, or features provided by a vendor). For example, certain third-party interactive features may allow you to share Services content to your social media profile.

We may also offer customer service features provided through a vendor where contents of your interactions with these features may be captured and kept as a transcript. By using these features, you understand that our vendors may process the information obtained through the feature, including to provide services on our behalf. If you provide your personal information to that third party through its websites or services, you will be subject to that third party’s privacy practices, policies, and terms of use. This Privacy Policy does not apply to any personal information that you provide to a third-party website or service.

CHANGES TO THIS PRIVACY POLICY

This Privacy Policy is subject to change at our discretion. We will indicate changes to the Privacy Policy by updating the “Effective date” at the beginning of the Privacy Policy. Your continued use of the Services after any update to this Privacy Policy will constitute your acceptance of the changes.
